Whereas, on January 20, 1971, based upon an assumption that relator, an inmate of a correctional institution in Virginia, would waive extradition, we rendered and entered judgment in this cause, instituted by relator Farris, directing that respondent set for hearing, within sixty days of the date on which our judgment became final, the motion of the State to revoke relators probation theretofore granted in Cause No. 13,223-A in the 30th Judicial District Court of Wichita County, Texas; and Whereas, the sixty days will expire on this the 19th day of April, 1971; and Whereas, this court has been furnished evidence that, instead of waiving extradition, relator has demanded a hearing on Texas petition to extradite him for the revocation hearing, and has requested appointment of counsel to represent him at such hearing;
