Cutujian appeals from a judgment of dismissal after the sustaining without leave to amend of a demurrer to his third amended complaint for nuisance, and from an order after judgment awarding $30,000 in attorney fees, plus costs, to the defendant, Benedict Hills Estates Association (""the Association""). The trial court's order was based on the Conclusion that Cutujian's complaint had not been filed within the relevant statutory period.
